Under the Mental Health Act 1983 certain people known as ‘qualifying patients’ are entitled to help and support from an IMHA. If there is a safeguarding matter whilst the IMHA is working with the adult, consideration for that person to be supported by the same advocate should be given. This does not negate the statutory duty to refer to IMCA
